HOUSE FLOOR AMENDMENT number ___1__ to HOUSE BILL 303, as amended
Amendment sponsored by Representative Rod Montoya
1. Strike all house commerce and economic development committee amendments.
2. On page 1, lines 21 and 22, remove the brackets and the line through "begin the construction or operation of" and strike the underscored language.
3. On page 2, line 1, remove the brackets and the line through "such construction or operation" and strike the underscored language.
4. On page 2, lines 23 and 24, remove the brackets and the line through "for the construction, development and extension" and strike the underscored language.
5. On page 3, lines 2 through 4, remove the brackets and the line through "for the construction or extension of a generating plant or transmission lines and associated facilities".
6. On page 5, line 25, strike the closing quotation mark.
7. On page 5, after line 25, insert:
"G. Notwithstanding the provisions of Subsection A of this section and prior to July 4, 2026, a public utility may start the construction of a public utility plant prior to obtaining a certificate of public convenience and necessity in order to qualify for federal tax incentives that will benefit ratepayers. Nothing in this subsection shall absolve the public utility from meeting the burden that the plant is cost-effective among feasible alternatives."".
